Terms of use
1. General
- These terms set out the rules for using the mobile game “Pstryk: Bestiary” (“Pstryk: Bestiariusz”) for iOS and Android (the “game”).
- The provider is Mateusz Wyszogrodzki, a private individual (the “developer”), e-mail: contact@
pstrykgame.com . - The game is a service provided electronically. These terms are available free of charge on this page, and the game links to them (Settings › Privacy). By downloading and launching the game you accept these terms and the terms of the store you got it from.
- How personal data is processed is described in the Privacy policy.
2. Services
- The game is free. It includes play in several modes, saving progress on your device and in the cloud (iCloud or Google Play Games), local score tables, local reminders (if you allow them) and sharing results.
- The game contains optional in-app purchases (section 5). Version 1.0 has no ads. The whole game can be completed without paying.
- No account is required.
3. Technical requirements
- An iPhone with iOS 15 or later, or a device with Android 7.0 or later and an up-to-date Android System WebView. The store listing shows the current requirements.
- An internet connection is needed only for purchases and restoring them, for cloud save and, if you agree, for sending statistics. Gameplay works offline.
- The developer cannot guarantee that the game works on every device that meets these requirements, but takes care that it runs smoothly on older phones too.
4. Conclusion and termination
- The agreement to use the game is concluded when you first launch it, for an indefinite period and free of charge.
- You may terminate it at any time by uninstalling the game. Before that you can delete your data in the game (Settings › Danger zone › Delete my data).
- The developer may stop offering the game with at least 30 days’ notice in the game or on this site. One-time purchases made earlier remain available in the installed game.
5. In-app purchases and amber
- You make purchases in the App Store (Apple) or on Google Play (Google). The store operator takes and processes the payment under its own terms. You see the price in your local currency before you buy.
- Amber is the game’s virtual currency. It has no monetary value and cannot be exchanged for money or for anything outside the game, cashed out, resold or transferred to another person. Amber does not expire. Amber and in-game items are part of your licence to use the game (section 7).
- Patron, Starter pack, the golden season trail and cosmetic sets are one-time purchases. You can restore them with Restore purchases (Settings › Purchases) on the same store account. The golden trail applies to the season named in the purchase description. Amber packs are consumable: the amber is added to your game balance, which cloud save keeps.
- Purchased items reach the game as soon as the store confirms the payment. If an item did not arrive, restart the game with an internet connection or use Restore purchases; if that does not help, contact the developer (section 9).
- The game has no paid randomness: you cannot buy random rewards or boxes with unknown contents. The daily reward wheel is free, shows the odds of every reward, and extra spins cannot be bought.
- Refunds are handled by the store operator under its own rules (Apple: reportaproblem.
apple.com , Google: your Google Play order history). The developer has no access to payments and cannot refund them outside the store.
6. Consumer rights
- If you are a consumer, you may withdraw from a distance contract within 14 days without giving a reason.
- For digital content not supplied on a physical medium (for example amber or Patron), this right ends once the supply has started with your express prior consent, after you acknowledged that you lose the right of withdrawal, and after you received a confirmation (Art. 16(m) of Directive 2011/83/EU, in Poland Art. 38(1)(13) of the Consumer Rights Act). The store handles the consent and confirmation at checkout, and the item reaches the game right after the purchase.
- If digital content does not conform to the contract (for example it does not work as described), you have the rights given by consumer law: you can ask for it to be brought into conformity and, if that is impossible or fails, for a price reduction or to terminate the contract.
7. Licence
- The game, its code, graphics, music and texts are protected by copyright and belong to the developer, except for fonts under the SIL Open Font License 1.1 (list and licences in the game: Settings › About).
- The developer grants you a non-exclusive, non-transferable licence to use the game for your own non-commercial purposes, for the duration of the agreement, on devices linked to the store account you downloaded it with, and in line with that store’s terms.
- You may not modify the game, bypass purchase protection, exploit bugs to get items without paying or distribute the game outside the stores, except where mandatory law allows it.
- The game does not publish content from players. Names you type in the game (for example in Duel) stay on your device. Providing unlawful content is prohibited.
8. Liability
- The developer takes care that the game works correctly and fixes reported bugs in updates.
- The developer is not liable for interruptions and errors caused by the stores, your phone’s system, iCloud or Google Play Games, or for progress lost after uninstalling the game or clearing its data while cloud save was off or unavailable.
- Nothing in these terms excludes or limits the developer’s liability where the law does not allow it, or limits your rights as a consumer.
9. Complaints
- Send complaints to contact@
pstrykgame.com . Describe the problem and include your player ID (Settings › Account and save) and, for a purchase, its date and the item’s name. - The developer replies within 14 days of receiving the complaint.
- You may also use out-of-court dispute resolution, for example the consumer ombudsman or consumer protection authority in your country (in Poland: prawakonsumenta.
uokik.gov.pl ).
10. Progress and updates
- Progress is saved on your device and, if you are signed in to iCloud or Google Play Games, in the cloud. One-time purchases can be restored (section 5.3).
- The game may be updated: we add content and fix bugs and balance. Updates never take away purchased items.
11. Changes to these terms
The developer may change these terms for important reasons (changes in law, in the game’s features or in third-party services). Changes will be announced on this site and in the game at least 7 days before they take effect. If you do not accept them, you may terminate the agreement by uninstalling the game.
12. Governing law and disputes
- Polish law applies to the agreement. If you are a consumer living in another country, you keep the protection of the mandatory rules of that country.
- Disputes are decided by the competent court under general rules. These terms do not take away a consumer’s right to go to the courts of their place of residence where the law grants it.
